Purpose<\/h2><p>These General Conditions of Use (hereinafter &#8220;GCU&#8221;) define the conditions under which AUVRAY SECURITY, a simplified joint stock company with capital of [to be completed], registered with the Romans Trade and Companies Register under number 488 087 719, whose registered office is located at 225 all\u00e9e du Lyonnais, 26300 Bourg-de-P\u00e9age, France, makes its connected services available to users, including :<\/p><ul><li>the Find&#8217;r mobile application,<\/li><li>connected products (GPS trackers, sensors, connected anti-theft devices incorporating A-where technology),<\/li><li>associated services (notification, geolocation, post-flight assistance, software maintenance),<\/li><li>and connectivity subscriptions.<\/li><\/ul><p>Access to or use of these services implies full acceptance of these GTU.<\/p><h2> <\/h2><h2>2. Scope of application<\/h2><p>These GCU govern :  <\/p><ul><li>access to and use of the Find&#8217;r mobile application and any other Auvray Security connected service;  <\/li><li>the use of associated hardware products (trackers, sensors, connected anti-theft devices);  <\/li><li>functionalities (geolocation, alerts, notifications, assistance, etc.);  <\/li><li>subscription services enabling the system to operate.<\/li><\/ul><p>They do not apply to sales of physical products or subscriptions, which are governed by the corresponding <strong>General Sales Conditions (GSC)<\/strong>.<\/p><p> <\/p><h2>3. Acceptance and modification<\/h2><p>By creating a user account, activating a connected product or using the application, the user acknowledges that he\/she has read and accepted these GTU.<br>AUVRAY SECURITY reserves the right to modify the GTU at any time.<br>The applicable version is the one published on the site or application at the date of use of the service.<br>Any substantial modification will be the subject of specific information to the user.<\/p><h2> <\/h2><h2>4. Access to services<\/h2><p>Access requires :  <\/p><ul><li>possession of a compatible product;  <\/li><li>a smartphone with an Internet connection and a compatible operating system;  <\/li><li>create a personal user account;  <\/li><li>and, depending on the case, an active subscription (offered for 1 year with the product, then renewable monthly or annually).<\/li><\/ul><p>Internet connection and telephone charges are the responsibility of the user. AUVRAY SECURITY endeavors to ensure continuous access to the services, but does not guarantee their uninterrupted availability (maintenance, updates, network failure, etc.). <\/p><h2> <\/h2><h2>5. How connected services work<\/h2><p>The Find&#8217;r and A-where products are based on a combination of :  <\/p><ul><li>Bluetooth and cellular connection (4G),  <\/li><li>servers hosted in France,  <\/li><li>and the mobile management application.<\/li><\/ul><p>Features may include :  <\/p><ul><li>real-time geolocation of equipped vehicles (accuracy varies according to network coverage) ;  <\/li><li>motion or attempted theft alerts ;  <\/li><li>push or SMS notifications ;  <\/li><li>post-flight assistance (in mainland France) ;  <\/li><li>view position history.<\/li><\/ul><p><em>  The Find&#8217;R application is compatible with smartphones running iOS 10+ and Android 6+.<\/em><\/p><p><em><br><\/em>  AUVRAY SECURITY may at any time add, modify or delete a feature for technical, regulatory or service improvement reasons.<\/p><p> <\/p><h2>6. Subscription and duration of service<\/h2><p>The purchase of a connected product includes an <strong>initial subscription period of one (1) year<\/strong>. At the end of this period, the user may renew the subscription on a monthly or annual basis. In the event of non-renewal :    <\/p><ul><li>the service remains suspended;  <\/li><li>after <strong>6 months<\/strong>, the integrated SIM card is terminated;  <\/li><li>any subsequent reactivation requires the <strong>product to be returned<\/strong> to Auvray Security for replacement of the SIM card, with a <strong>fixed charge of \u20ac40 including VAT<\/strong>, as well as shipping and return costs to be borne by the customer.<\/li><\/ul><p>AUVRAY SECURITY may interrupt the service in the event of cessation of the underlying technology (e.g. cessation of the 4G network), failure of a technical service provider or for security reasons.<br>No compensation will be due in the event of a service interruption made impossible by an external factor (technology stoppage, legal modification, force majeure).<\/p><p> <\/p><h2>7. Personal data and geolocation<\/h2><p>The services collect and process certain data necessary for their operation:  <\/p><ul><li>identification data (name, e-mail, product ID) ;  <\/li><li>technical data (serial number, model, software version) ;  <\/li><li>location data (GPS coordinates, position history) ;  <\/li><li>usage data (alerts, device status, subscription status).<\/li><\/ul><p>This data is processed in accordance with <strong>Regulation (EU) 2016\/679 (RGPD)<\/strong> and the French Data Protection Act.<\/p><p>The <strong>data controller<\/strong> is: <strong>AUVRAY SECURITY<\/strong>, 225 all\u00e9e du Lyonnais, 26300 Bourg-de-P\u00e9age, France.<br>Data is <strong>hosted in France<\/strong> and is <strong>not transferred outside the European Union.<\/strong><\/p><p>Geolocation data are used exclusively :  <\/p><ul><li>for service operation ;  <\/li><li>for after-flight assistance ;  <\/li><li>or, with explicit agreement, for transmission to partner authorities or insurers.<\/li><\/ul><p>Each user has a right of access, rectification, deletion, limitation and opposition that can be exercised by e-mail:<br><a href=\"mailto:dpo@auvray-security.com\">dpo@auvray-security.com<\/a><\/p><h2> <\/h2><h2>8. Responsibilities<\/h2><p>AUVRAY SECURITY makes every reasonable effort to ensure the availability and reliability of its services.<br>However, the company cannot be held responsible for :  <\/p><ul><li>loss of GPS or cellular signal;  <\/li><li>geolocation errors;  <\/li><li>malfunctions related to a telecom operator, network coverage or phone compatibility;  <\/li><li>improper use, installation or configuration of the product;  <\/li><li>a temporary interruption for maintenance ;  <\/li><li>or indirect damage (loss of data, commercial loss, etc.).<\/li><\/ul><p>AUVRAY SECURITY&#8217;s total liability is limited to the amount paid by the user for the service concerned.<\/p><h2> <\/h2><h2>9. User obligations<\/h2><p>The user undertakes to :  <\/p><ul><li>use the service in accordance with the law ;  <\/li><li>do not hijack the system;  <\/li><li>do not attempt to access other people&#8217;s data;  <\/li><li>keep your equipment up to date ;  <\/li><li>protect your login and password ;  <\/li><li>Immediately report any theft, loss or malfunction of the device via the application or customer service.<\/li><\/ul><p>Any breach may result in suspension or termination of access to the service.<\/p><p> <\/p><h2>10. Intellectual property<\/h2><p>The brands, logos, texts, images, databases, software and all elements making up the services are the exclusive property of AUVRAY SECURITY or its partners. Any unauthorized reproduction, distribution or use is strictly prohibited. The user has only a personal, non-exclusive and non-transferable right to use the service in accordance with these GCU.  <\/p><p> <\/p><h2>11. Suspension and termination<\/h2><p>AUVRAY SECURITY may suspend or terminate a user&#8217;s account:  <\/p><ul><li>in the event of non-compliance with the GCU ;  <\/li><li>in the event of abuse, fraud or illicit use;<\/li><li>or in the event of non-payment of a subscription.<\/li><\/ul><p>The user may delete his account at any time from the application or by written request.<\/p><h2> <\/h2><h2>12. Security and updates<\/h2><p>AUVRAY SECURITY applies appropriate technical and organizational measures to ensure data and service security.<br>Software updates may be automatically deployed to correct faults or improve the service.<br>The user undertakes to keep his application and product up to date.<\/p><p> <\/p><h2>13. End of life or termination of service<\/h2><p>AUVRAY SECURITY will inform users within a reasonable period of time in the event of the permanent cessation of a service due to technological change (e.g. the cessation of a cellular network) or the failure of a technical supplier.<br>No compensation will be due, as these events are beyond the company&#8217;s control.<\/p><p> <\/p><h2>14. Third-party links and services<\/h2><p>The service may contain links to other sites or applications.<br>AUVRAY SECURITY accepts no responsibility for their content or security.<br>Certain partner services (insurance, law enforcement) may require the transmission of data, subject to the user&#8217;s explicit agreement.<\/p><p> <\/p><h2>15. Applicable law and jurisdiction<\/h2><p>These GCU are governed by French law. However, if the user is a consumer residing in another member state of the European Economic Area, he\/she shall also benefit from the mandatory provisions of protection provided by the law of his\/her country of residence. In the event of a dispute, the French courts will have jurisdiction, subject to the mandatory legal provisions applicable to consumers.  <\/p><p> <\/p><h2>16.
